Fraud, money laundering, sanctions evasion, and all that fun stuff? Still on the DOJ’s radar. So, if you’re creating a tool to help crooks move dirty money, yeah, you might want to rethink that career choice. (Or just go back to building a cute dog GIF generator instead.)
So, don’t go thinking you’re invincible now. As Galeotti put it, prosecutors will actually need to prove intent before bringing charges, instead of just waving around accusations about code like they’re tossing confetti. 🥳
The Tornado Cash Drama (Or, Why This Is Probably About Time)
Now, onto the juicy part. Tornado Cash’s co-founder Roman Storm was recently convicted on conspiracy charges, accused of allowing shady characters to use the protocol for illicit activities. In case you missed it, Tornado Cash was built to protect privacy-something that’s obviously not everyone’s cup of tea. 🫖
Storm and his team insisted they didn’t knowingly help criminals, but the DOJ wasn’t having it. The co-founders fought for their freedom, but in the end, one of them ended up behind bars. A nice little reminder that “open-source” doesn’t always mean “free from consequences.”
And then there’s Samourai Wallet, where the founders were recently found guilty of operating an unlicensed money-transmitting business. Because mixing coins (not the kind you find in your pocket) equals laundering crime money, apparently. 🙄
Industry insiders have been crying foul over these cases, saying the DOJ’s crackdown set a dangerous precedent that could kill innovation. So, does the new policy mean the DOJ will roll back those convictions? Will it give the developers a get-out-of-jail card? Well, that’s still up in the air.
One thing’s for sure, though: With this new policy shift, developers who mean well no longer have to wonder if their next GitHub push will land them in court. Phew! 🥳
